These terms apply to new agreements for which DustinLabs makes them available and declares them applicable before the agreement is concluded. In the event of a conflict, a quotation or written agreement concerning your assignment takes precedence. Written communication also includes email. Publication of this version does not automatically change existing agreements.
DustinLabs focuses on businesses. If you purchase as an individual outside your business or professional activity, you are a consumer and all mandatory consumer rights continue to apply. Further information about the cooling-off period is provided in article 13.
2. Proposal and agreement
An enquiry or introductory meeting does not commit you to an assignment. For custom work, an agreement is formed when you accept the proposal and DustinLabs confirms the assignment. The proposal states the work, the price or calculation method, the schedule and any third-party costs. We agree any changes or extensions together in advance.
When ordering online, you review the selected service, price, billing and details entered before the payment step. The confirmation and agreed order form the agreement. Payment and any checks must be completed before registration or setup begins. An availability check does not reserve a domain name; registration is only certain after confirmation by the registry.
3. Delivery of services and cooperation
DustinLabs carries out the agreed work with care and professional skill. You provide the necessary content, rights, feedback and access in good time. Only grant access needed for the work, and do not send passwords or secret keys through a public form.
The schedule depends on timely cooperation and the availability of the required services. If a delay is likely, we discuss the consequences and a revised schedule. Any deadline expressly agreed as binding remains binding. We inform you in advance when additional work will cost extra time or money; we carry out paid additional work only after approval.
4. Websites, software and delivery
The proposal defines the pages, features, revision rounds, integrations and delivery. You have an opportunity to assess the result against the agreed requirements. Describe any discrepancies as specifically as possible so DustinLabs can investigate and fix them. Silence is not automatically treated as approval and does not rule out a later justified claim regarding defects.
Hosting, updates, maintenance, copy, photography, licences and new features are only included to the extent stated in the order or quote. Changes to an external API or service may require adjustments. We first discuss what falls within existing maintenance and what constitutes separate work.
5. Hosting, email and domain names
Your chosen package determines storage, data transfer, email usage and other capacity. Stay within those limits and use the service lawfully. For recurring overuse, we discuss a suitable solution and any additional costs in advance. Temporary additional capacity does not change the subscription price without a new agreement.
DustinLabs uses OXXA for hosting and domain services. The backup service ordered supports recovery; also keep your own usable copy of important files and email. A backup is not an unlimited archive. Retention periods, restore options and any paid recovery work depend on the package or quote.
Maintenance, security incidents or faults can affect availability. DustinLabs makes efforts to resolve faults and informs you of relevant consequences. A specific uptime guarantee, response time or 24/7 availability applies only if separately agreed. This does not limit statutory rights in the event of defective service.
You are responsible for accurate registrant details and a domain name that does not infringe others' rights. The relevant registry's rules may be required for registration and transfer; applicable terms are provided before the assignment. Transferring a domain does not automatically terminate hosting or email. Arrange the transfer and data handover before termination to avoid losing availability.
6. Prices, invoicing and payment
The quotation or order step states what you will pay. Business amounts exclude VAT unless stated otherwise; fixed prices on the website also show the amount including VAT. Hosting ordered online is billed monthly, and domain registration is billed separately each year. Advertising budget, paid licences and external subscriptions are included only when explicitly stated.
You pay within the agreed period or by the due date on the invoice. Unless otherwise agreed, the payment period is 30 days. Online orders may require advance payment. When making a manual bank transfer, include the invoice reference in the description; the customer reference identifies your account and does not replace that invoice reference.
If payment is late, we contact you first. Statutory interest and reasonable collection costs may only be charged when the legal conditions are met. A consumer first receives the legally required free payment reminder, allowing 14 days to pay. Any suspension is proportionate and follows a warning and an opportunity to remedy the issue, unless immediate intervention is necessary.
7. Mollie and direct debit
Payments use the payment options offered by Mollie at checkout. A valid mandate is required for subsequent payments. Providing an IBAN alone is not sufficient. When enabling direct debit for an existing subscription, you complete a € 0,01 verification payment with Mollie.
You receive the invoice and advance notice at least 14 days before the direct debit. The mandate applies to the agreed amounts and intervals. You pay existing outstanding invoices separately, unless clearly agreed otherwise. You can revoke the mandate through the contact form; this does not automatically end the agreement, and outstanding invoices remain payable. Statutory chargeback rights remain in place.
8. Term, renewal and cancellation
New hosting subscriptions can be cancelled monthly with one month's notice. There is no minimum annual term unless separately and expressly agreed. After cancellation, the service ends no later than one month after receipt of your notice, or on a later date you request. Any prepaid amount for the period after the end date is settled.
Domain registrations run yearly and renew annually unless you cancel. Tell us before the next renewal if you want to discontinue the domain; use the renewal date in the confirmation or request it from us. Registration periods already carried out are not refunded partway through, subject to statutory rights such as withdrawal or a shortcoming by DustinLabs. After tacit renewal, a consumer may cancel with no more than one month's notice. Amounts prepaid for the period after that end date are settled accordingly.
You can cancel through the contact form or through the options on Cancellation and withdrawal. State the service or domain and the date you want it to end. You will receive confirmation of the end date. Request an export or transfer token in good time. Access ends when the service is terminated; data is deleted in accordance with the applicable retention arrangements.
Other ongoing services are subject to the duration and cancellation terms expressly agreed. Without an agreed fixed term, you can cancel with one month's notice. If a custom assignment is cancelled, we charge for work already completed and reasonable, demonstrably incurred commitments, within the limits of the law. Consumers do not pay a fixed penalty for cancelling a services agreement.
9. Acceptable use and intervention
Do not use hosting, email or software for illegal content, phishing, malware, spam, intellectual property infringement or unauthorised access. You must have the rights and permissions required for the content you provide or publish.
When a specific report is received, we investigate the content concerned and weigh the rights and interests of those involved. A measure may involve a request for changes, restriction of specific content or, where necessary, temporary suspension. We limit the measure to what is needed, explain the decision and provide an opportunity to respond. Immediate action may be needed in the event of imminent danger or a binding order. More information and ways to report concerns are available under Complaints and reports.
10. Content, rights and confidentiality
The files you provide, your domain name and existing rights remain yours or those of the original rights holder. DustinLabs uses them only for the assignment. After full payment, you may use the work delivered specifically for you for the agreed purpose. Any transfer of copyright or exclusivity must be agreed in writing. Reusable tools and third-party components retain their own rights and licences.
The parties handle confidential business information carefully and share it only to perform the assignment, with permission or when required by law. A customer name, logo or project is not used as a public reference without permission. If DustinLabs processes personal information on your behalf, we put the necessary data processing agreements in place before processing begins, including the purpose, security, suppliers involved and deletion.
11. Advertising, automation and AI
For Google Ads, we agree management work and the advertising budget separately. Advertising platforms also influence auction prices, approvals and reach. DustinLabs does not promise a fixed number of leads, revenue, search ranking or advertising result unless this has been expressly and specifically agreed.
Automation and AI support the agreed process. AI output can contain errors. Human review is needed before making important decisions, sending customer communications or publishing data. We agree which data and suppliers may be used for an application. A chatbot or automation does not replace a legal, medical or financial professional.
12. Problems, liability and force majeure
Report a problem as soon as reasonably possible, including a description and relevant information. DustinLabs is given a reasonable opportunity to remedy a shortcoming, except where a remedy is impossible or the law directly grants other rights. This does not exclude your statutory rights to performance, termination, a price reduction or compensation.
In the event of damage, statutory rules on liability, attribution of responsibility and mitigation of loss apply. These terms do not exclude liability in general. A separate limitation applies only if validly agreed and does not affect mandatory law or liability that cannot be excluded.
If an impediment beyond a party's responsibility arises, we inform each other and limit its consequences. A supplier problem does not automatically constitute force majeure. If the impediment lasts so long that continuing cannot reasonably be required, we seek an appropriate termination and settlement. Services that have not been delivered are not invoiced as delivered.
13. Cooling-off period for consumers
As a consumer, you can withdraw from a distance service contract without giving a reason until 14 days after the day it was concluded. Clearly notify us of your withdrawal before the period ends. Use the button Withdraw from agreement, use the withdrawal form on that page, or write to our address above. You may use the model form below, but you are not required to.
In the event of a valid withdrawal, we make the refund due no later than 14 days after your notice, using the same payment method unless you agree to another method at no cost to you. A proportionate amount may be due for work performed only if you expressly requested performance during the cooling-off period and were properly informed. Losing the cooling-off right after full performance requires prior express consent and acknowledgement. Accepting the terms and conditions or making a payment alone is not sufficient.
Our standard online checkout does not waive your cooling-off period. A domain name or custom assignment is not automatically excluded. Business purchases do not have a statutory consumer cooling-off period.
14. Model withdrawal form
Only complete and send this form if you wish to withdraw from the agreement.

15. Changes and disputes
A new version applies to new agreements. Changes to an ongoing agreement are governed by the existing arrangements and the law. A price increase or adverse change is explained to you personally in advance and does not take effect merely because this web page has been updated. Where required, you are given the option to end the agreement at no cost before the change.
Dutch law applies to the agreement. Mandatory protection to which a consumer is entitled in their country of habitual residence remains applicable. We first try to resolve a dispute together. If that is unsuccessful, you may bring it before the court with jurisdiction under the law. See also the complaints procedure.
